While Yolanda gathered the complainants' statements, Pruitt made his own decision, slowly, the way a man near retirement makes a decision that will change how he is remembered. He met with Yolanda again, this time with a union representative present, and he told her he was ready to stand behind the notebook himself, in writing, and in person if needed, because a notebook handed over in confidence was a beginning, but a notebook stood behind in public was a testimony. He wrote a statement, in his own hand, on lined paper, describing the notebook, describing the eleven stops, describing the rewritten reports, describing Boone's signatures on the reports and the overtime sheets, describing his own silence at the pavilion and his regret for it. He signed it. He dated it. He gave Yolanda permission to share it with the prosecutor, because a prosecutor, he said, was the person who could decide whether a case against Desmond should go forward, and whether a case against Grady and Boone should begin. Yolanda thanked him, and Pruitt, who had spent thirty years being thanked by people for small courtesies, nodded and said, "I am not looking for thanks. I am looking for a clean record before I retire. A man should leave a job with his book in order." Desmond, when he heard about the statement, asked Yolanda to tell Pruitt something for him, not a legal message but a human one. "Tell him I understand silence," Desmond said. "Tell him I know how hard it is to speak when speaking costs something. Tell him I am grateful he spoke." Yolanda delivered the message, and Pruitt, according to Yolanda, was quiet for a long time after hearing it, and then said, "Tell Mr. Hayes his grill was still smoking when we left, and I have thought about that grill every day since. A man should not lose his cookout for asking a question." It was not an apology in formal words, but Desmond, hearing it, understood it as one, and he accepted it the way he accepted apologies from students, not as an ending but as a beginning.

The prosecutor's office received Yolanda's file in a thick envelope, with a cover letter that listed its contents in order, the way a librarian lists the contents of a box. The permit, certified. The dispatch logs, certified. The films, with dates. The parents' statements. Hattie's statement. Otis's citation and photographs. Alma's permit and photographs. Ellis's citation and picnic program. Pruitt's notebook, copied page by page, with the original held safe. Pruitt's signed statement. The overtime records, with Boone's signatures marked. The complaint-search letter, stating that no complaints had been found. Yolanda did not ask the prosecutor for a favor. She asked for a reading, a careful reading, of papers that did not agree, and for a decision based on that reading. Desmond and Tanya waited, as families wait for decisions that are not theirs to make, by teaching and working and coaching and keeping the folder up to date, adding each new letter to it in order, writing the date on the front each time it grew thicker. Jordan, at practice, played with a focus that his coach recognized as a boy working out feelings through effort. Nia, at home, wrote thank-you notes to the families who had stayed at the pavilion after the patrol car left, notes in her neat handwriting, thanking them for staying, for helping, for cleaning up, for being a team even when the cookout had ended early. Hattie brought over a third pie, and this time she stayed for supper, and she told stories about Oakwood Terrace in the years before Desmond and Tanya had moved there, stories about neighbors and parks and the long, slow work of making a place feel like home. The waiting, Desmond learned, was not empty time. It was time filled with ordinary life, going on, stubbornly, while a file made its way through an office.
