“This homeowner is obstructing lawful inspection.”
Coleman asked, “Has he committed a crime?”
“No.”
“Is there an emergency?”
“Potentially.”
“What emergency?”
“We can't know without inspection.”
“That isn't an emergency.”
Silence.
Carol's carefully prepared argument was collapsing in real time.
I offered to show the deputies my camera footage.
Coleman agreed.
I played the clips.
Carol photographing my gate.
Carol measuring my fence.
Carol crouching beside the keypad.
Carol peering through the bars.
Then the final clip.
Carol opening the side panel and stepping one foot onto my land.
Neither deputy interrupted.
When the footage ended, Coleman looked at her.
“Have you entered this property without permission?”
“I was performing association duties.”
“That wasn't my question.”
“I have obligations.”
“Not to enter private land.”
“I never fully entered.”
Reyes spoke quietly.
“The video shows your foot past the gate line.”
Carol looked at him as though he had personally betrayed her.
Then Walter appeared at the roadside.
He had seen the patrol car.
He had seen Carol.
And he had apparently decided he had waited long enough.
“Deputy,” he said, “she's done this before.”
Carol snapped, “Walter, this doesn't concern you.”
Coleman turned toward him.
“Go ahead, sir.”
Walter told them everything.
The fines.
The pressure.
The residents who had sold their homes.
The rules nobody could find.
The people who had been too exhausted to fight.
Coleman took notes.
Then he gave Carol the answer she had never expected.
The HOA had no authority to force entry without legal authority.
Law enforcement could not be used as a weapon in a civil HOA dispute.
If the association believed I had violated a rule, it could pursue the matter through the proper civil process.
But deputies were not there to open my gate.
Then Coleman apologized to me for the disruption.
The patrol car left.
Carol remained outside.
