The Pool Becomes the Target
The pool became Patricia's favorite weapon.
At a crowded HOA meeting, she projected an aerial photograph of Ethan's property onto the clubhouse wall.
A red circle surrounded the pool.
“This unauthorized water feature creates risk for the entire community,” Patricia announced.
Ethan sat in the third row.
He raised his hand.
She ignored him.
He stood anyway.
“How?”
Patricia frowned.
“Excuse me?”
“What risk?”
“Water use.”
“The pool is spring-fed.”
“From a resource inside the community watershed.”
Ethan looked around.
“Watersheds aren't HOA property.”
Several residents shifted in their chairs.
Patricia lifted her chin.
“We have a responsibility to manage shared resources.”
“Then show me the recorded easement.”
Silence.
“Show me a utility connection.”
Nothing.
“A meter?”
Still nothing.
“A maintenance agreement?”
Patricia closed the binder.
“We're not going to turn this meeting into one homeowner's personal grievance.”
“I'm not a member.”
“You live inside the community.”
“No.”
Ethan held up a county plat.
“My parcel touches Pine Hollow on two sides.”
He pointed to the boundary.
“The boundary stops here.”
A retired city planner named George Benton leaned forward.
Ethan handed him the map.
George studied it.
Then looked at Patricia.
“He's right.”
The room changed.
Only slightly.
But Patricia noticed.
She immediately shut off the projector.
“Meeting adjourned.”
Two weeks later, Ethan received a $2,500 invoice for “illegal community water use.”
He walked to Patricia's house.
She was trimming roses.
“Is this serious?”
She looked at the paper.
“Very.”
“I don't use community water.”
“You use water inside the community.”
“That sentence doesn't mean anything.”
“Pay the fine.”
“No.”
Patricia clipped another rose stem.
“Then it increases.”
Ethan stared at her.
“You know my parcel isn't subject to your covenants.”
“I know you want to believe that.”
“Whose legal opinion are you relying on?”
Patricia smiled.
“Mine.”
Ethan walked away.
That answer stayed with him.
Not because it was legally meaningful.
Because it revealed the real problem.
Patricia didn't misunderstand authority.
She believed authority was whatever she could convince other people not to challenge.
