HOA Demanded I Fill In My Swimming Hole — Too Bad It's a Protected Natural Spring
Chapter 4
He finally looked interested.
I pointed toward my phone.
“And this conversation is being recorded.”
His partner stepped closer.
“What did she tell you this was?”
“A landscaping dispute.”
“That's not what it is.”
I showed him the DEP information.
“If you put that Bobcat on my property, you're exposing your company to potential state enforcement.”
His expression changed.
He looked at his partner.
Then at the spring.
Then back at me.
“She said it was a pool.”
“It isn't.”
“She said the homeowner was refusing to comply.”
“She left out the environmental issue.”
The foreman rubbed his forehead.
“I'm not getting involved in this.”
He turned around.
“Load the machine.”
The two men began securing the Bobcat.
That's when I noticed something.
Two streets away.
A white Lexus.
Karen was sitting inside.
Watching.
I raised my phone slightly.
I made sure the camera captured her car.
She had wanted to see dirt thrown into my spring.
Instead, she watched her plan collapse.
The truck left.
The neighborhood was quiet again.
But the video changed everything.
I sent it to Mrs. Gable.
She sent it to Mr. Martinez.
By evening, nearly everyone had seen it.
For the first time, the residents of Harmony Creek saw Karen's authority without the paperwork surrounding it.
They saw the truck.
They heard the foreman.
They saw Karen watching from a distance.
That night, my doorbell rang.
Mr. Martinez stood there.
Behind him were three other families.
“We saw the video.”
I nodded.
“What do you want to do?”
“I don't know yet.”
Mrs. Gable stepped forward.
“I do.”
She lifted her chin.
“We get rid of her.”
Within an hour, my living room was full.
Violation notices covered the coffee table.
Trash-can fines.
Paint fines.
Garden fines.
Basketball-hoop fines.
Holiday-decoration fines.
And the spring.
One by one, people spoke.
The same story repeated itself.
Karen didn't need everyone to agree with her.
She only needed everyone to be afraid of her.
Until now.
“We need an alliance,” I said.
Mrs. Gable smiled.
“What kind?”
“The kind that follows the rules.”
We called it the Harmony Creek Homeowners Alliance.
Our goals were simple.
Recall Karen.
Audit the HOA.
Rewrite the worst rules.
Frank helped us examine the bylaws.
We needed thirty signatures.
There were 120 homes.
Thirty.
That was all.
We started knocking on doors.
We expected resistance.
Instead, people opened their doors before we even knocked twice.
By the end of the weekend, we had seventy-eight signatures.
Then something unexpected happened.
Barry, the HOA treasurer, contacted me.
He didn't come to the front door.
He left an envelope in my mailbox.
Inside was a USB drive.
And a note.
I'm sorry. I was afraid of her. Look in the landscaping and maintenance budget.
I stared at the message.
Then I looked at Sarah.
“Mark?”
I plugged the drive into my computer.
Three years of HOA financial records appeared.
Invoices.
Payments.
Bank transactions.
And one company appeared again and again.
Creative Community Solutions.
The payments were enormous.
Thousands of dollars.
Then I checked the state business registry.
The company was registered under Karen's maiden name.
The address was her house.
I leaned back.
For months, I'd thought Karen was drunk on power.
Now I realized something worse.
She might have been using that power to steal from us.
Frank arrived the next morning.
I put the financial records in front of him.
He read silently.
Then he looked at me.
“How much?”
“Forty-eight thousand two hundred fifty dollars.”
His expression hardened.
“And that's what we can prove.”
We spent the entire day reviewing invoices.
“Beautification.”
“Consulting.”
“Seasonal planting.”
“Community enhancement.”
The descriptions were vague.
The payments were not.
Money had flowed from the HOA to Creative Community Solutions repeatedly.
The company was Karen's.
Frank leaned back.
“This is no longer just an HOA dispute.”
“I know.”
“This could be criminal.”
The Harmony Creek Alliance moved quickly.
Frank prepared legal filings.
We submitted evidence to the relevant agencies.
The DEP received the video and the original letters.
The HOA regulatory authorities received the financial records.
The recall petition was submitted.
Then Frank contacted an investigative reporter named Jessica Vale.
