“Who told you to enter the Walker property?”
“Linda Mercer.”
“Why did you go at night?”
“She said Mr. Walker was confrontational.”
“Had you met him?”
“No.”
“Had he threatened you?”
“No.”
Naomi approached the witness stand.
“Why did you describe his cabin as noncompliant?”
“That was the term Linda used.”
“Noncompliant with what?”
Marcus hesitated.
Then he answered.
“The development plan.”
The courtroom became silent.
“What development plan?”
“The Western Summit expansion.”
Linda's attorney objected.
The judge overruled him.
Marcus looked toward Linda.
“She said the road had to be controlled before construction approvals could move forward.”
“Did Ethan Walker agree?”
“No.”
“Did Pine Ridge own the road?”
“No.”
Naomi waited.
“Then what did control mean?”
Marcus looked down.
“It meant making him follow HOA rules until he either signed or left.”
The truth had finally been spoken plainly.
They had never wanted compliance.
They had wanted surrender.
One Question Too Many
Linda Mercer chose to testify.
Her attorney advised against it.
She insisted.
On direct examination, Linda described herself as a dedicated community leader. She spoke about drainage risks, emergency access, and the responsibilities of protecting a neighborhood.
Then Naomi Price stood for cross-examination.
She began with a single question.
“Identify the statute.”
Linda blinked.
“What?”
“The statute giving Pine Ridge HOA jurisdiction over the Walker road.”
“Property law is complex.”
“I didn't ask whether it was complex.”
Naomi waited.
“I asked for the statute.”
Linda spoke about broad authority and interacting legal principles.
Naomi asked her to name one.
Linda couldn't.
Naomi displayed the attorney's warning.
“Your lawyer told you the HOA had no jurisdiction.”
“That was one opinion.”
“You asked for a more aggressive interpretation.”
“Yes.”
“Did any licensed attorney provide one?”
“Not in writing.”
The prosecutor displayed the fake inspection records.
“You had time to hire patrol officers.”
The surveillance photographs appeared on the courtroom screen.
“You had time to install cameras.”
The rental agreement followed.
“You had time to create a fake county inspection.”
Then came photographs of the checkpoint.
“You had time to build a roadblock.”
Naomi looked directly at Linda.
“But you didn't have time to find one valid law?”
Linda's face turned red.
“We believed the drainage connection created jurisdiction.”
“Who is we?”
“The board.”
Naomi displayed the meeting minutes.
