HOA Refused My $63,500 Road Repair Bill—So I Shut Down the Only Gate to Their Lake Houses

Lake View Pines contained thirty-four houses built along the western edge of Lake Emory. The homes were large, expensive, and positioned to make every sunset look privately commissioned. Most included docks. Several had outdoor kitchens. One had an infinity pool facing a body of water considerably larger than the pool, which seemed like an expensive way to admit defeat.
The neighborhood surrounded my land but did not include it. That distinction appeared in every deed, survey, plat, tax record, and closing package connected to the development. My grandfather bought sixty-two acres in 1972. The property included shoreline, wooded frontage, and a narrow road leading from County Route 18 toward the western side of the lake. For decades, the road served our house, equipment sheds, and a small fishing cabin. It was private. Not private in the poetic sense. Private in the title-recorded, tax-assessed, survey-marked sense.
When a developer purchased the surrounding land in 2007, he discovered the only practical route into his proposed subdivision crossed my property. The northern terrain was steep and wet. The eastern approach required a bridge. The southern route would have crossed protected marsh. My road was already there. Flat enough. Wide enough. Connected to the county highway.
My father handled the original negotiation. The developer received access. We retained ownership. The agreement specified residential traffic, maintenance responsibilities, gate rights, repair-cost sharing, insurance, emergency access, and limits on commercial use. The subdivision plat identified the route in block letters. CALLAHAN PRIVATE ROAD. TITLE IN FEE SIMPLE: CALLAHAN FAMILY TRUST. DEED BOOK 412, PAGE 88.
There was no hidden clause. No ambiguous shaded area. No forgotten handshake. Every buyer in Lake View Pines received a title search. Every title search named the private road. Every closing attorney saw the access agreement. You could not buy a home there without reading—or paying someone to read—the fact that your driveway began on land owned by another family.
When the HOA incorporated in 2009, we renegotiated directly. The new agreement replaced the developer’s temporary arrangement. Twelve pages. Attorneys on both sides. County recording. Book 847, Page 223. The terms were simple. The HOA received guaranteed vehicular access for residents, guests, deliveries, maintenance, and emergency services. I maintained the road and gate. The HOA paid its proportional share of documented repair costs. Ordinary work required invoices. Extraordinary use required advance approval. Events involving commercial vehicles required notice. Damage caused by HOA-sponsored activity became the HOA’s responsibility.
Failure to pay after final demand activated Section 4B. Suspend access. Wait for payment. Reopen.
For eleven years, the agreement worked. The HOA paid for resurfacing, drainage work, snow removal, culvert cleaning, and one gate-motor replacement. No arguments. No threats. No emergency meetings. I sent an invoice. The treasurer reviewed it. The board issued a check. Once, the prior president mailed a handwritten note thanking me for clearing storm debris before residents returned from work. That was governance functioning properly.
Then Diane Marsh became president.
She ran in 2021 on "fiscal accountability." Diane loved accountability the way some people love wildlife. It was wonderful when observed from a safe distance and deeply unpleasant when it entered her own yard. She won by eleven votes. Within her first year, Lake View Pines issued forty-seven violations. That was more than the previous six boards combined. She hired a compliance consultant named Dale Mercer. No relation to me.
Dale drove through the neighborhood twice a month photographing mailboxes, fences, boats, planters, vehicles, paint colors, garden structures, and anything else that might justify an invoice. He sent the photographs to Diane. She decided what became a violation. The board approved her recommendations in groups, often without seeing the original images. Fifty dollars for a mailbox three inches above the approved height. Seventy-five for visible doorbell-camera wiring. One hundred twenty-five for outdoor furniture in a shade Diane described as "inconsistent with neighborhood aesthetic continuity." That phrase appeared on five different notices. Nobody knew what it meant. Everyone understood what it cost.
Disputing a fine triggered a formal compliance review. The review included an inspection fee, document fee, hearing fee, and administrative closure fee. A homeowner could win the original dispute and still spend several hundred dollars escaping the process. Diane understood the math. Most people paid.
George and Evelyn Henderson lived near the lake entrance. Both were retired teachers in their seventies. Evelyn kept three bird feeders against the side fence. Dale cited them under a rule prohibiting structures attracting wildlife within thirty feet of a common boundary. He measured from the nearest fence post rather than the actual boundary line. The difference mattered. The feeders complied. George challenged the measurement. Diane opened a formal review. The Hendersons spent $480 closing a case over three bird feeders. They removed them. After that, disputes across Lake View Pines dropped sharply. Diane called it improved compliance. I called it successful intimidation.
My land remained outside HOA jurisdiction. That did not stop her from sending notices. Mailbox height. Trash-can retrieval schedule. Border landscaping. An equipment trailer visible from the access road. Each notice cited Lake View Pines covenants that did not apply to my parcel. I answered the first four. One letter each. Deed date. Survey.
