After the fourth response, Diane began addressing notices to OCCUPANT rather than Frank Callahan. I filed every one. Forty years of engineering had taught me paper could become armor or ammunition. You rarely knew which until stress reached the joint.
The Fall Community Showcase occurred on October 14, 2023. Diane promoted it as a major neighborhood event. Food trucks. Bounce house. Craft vendors. Live music. Wine tasting. Children’s activities. She obtained a county event permit.
She did not request permission to use my road. She did not notify me that heavy commercial vehicles would arrive.
At nine that morning, I was drinking coffee when the first truck passed the house. A refrigerated catering unit. Wide body. Dual rear axle. Loaded heavily enough for the suspension to sit low. Then came a flatbed carrying tents. Two food trailers. A bounce-house van. A delivery truck carrying tables and portable refrigeration.
My road had been designed for passenger cars, pickup trucks, school buses, ordinary delivery vans, and emergency vehicles. It was not rated for repeated concentrated loads from heavy commercial traffic. The subgrade had not been assessed for that use in eight years. I stepped outside and photographed each vehicle. Not because I expected damage. Because engineers document loads. We are professionally incapable of watching weight cross pavement without calculating what lies beneath it.
The event lasted all day. More than two hundred people attended. Cars traveled in and out continuously. At four in the afternoon, vendors began leaving.
The refrigerated truck approached the gate too fast. The driver misjudged the swing radius of the electronic barrier arm. Its upper rear frame caught the aluminum gate arm. I heard the impact from inside my house. A metallic crack. Then scraping. The sound of a heavy diesel engine straining against a sudden, immovable object.
By the time I walked down the driveway, the truck was stopped. The heavy-duty gate arm was bent at a grotesque ninety-degree angle. The motor housing was cracked open, exposing the sheared gears inside. The driver looked terrified. I didn't yell. I took photographs of the truck, the license plate, the DOT number on the door, and the shattered gate mechanism.
"I'm so sorry, man," the driver stammered. "The HOA lady told me this gate stayed open all day."
"It does," I replied calmly. "Right up until 4:00 PM. As programmed."
The next morning, I had a commercial gate technician on-site. The damage was extensive. The motor unit was destroyed, the mounting post was warped, and the electronic sensor array was fried. Total cost for emergency replacement and recalibration: $8,450.
I drafted a polite letter to the Lake View Pines HOA Board, care of Diane Marsh. I included the invoice from the gate company, photographs of the damage, and a copy of the 2009 Access Agreement, specifically highlighting the clause regarding damage caused by HOA-sponsored events. I requested payment within thirty days.
Three days later, I received an email from Diane. It was not addressed to Frank Callahan.
Dear Occupant, The Lake View Pines Homeowners Association accepts no liability for third-party vendors. Your dispute is with the catering company. Furthermore, the gate poses an aesthetic eyesore in its current damaged state. You are hereby issued a warning to repair the structure within 72 hours, or face a non-compliance fine of $150 per day.
